This implementation-ready policy draft is not a substitute for professional legal advice. Curio should obtain review by qualified Indian and international counsel before accepting live transactions.

01

Agreement and operator

These Terms apply when you browse, register, buy, sell, message or otherwise use Curio Gallery. By using the service, you agree to these Terms and the linked Privacy, Shipping and Returns Policies.

Curio is managed from India and serves international users. Mandatory consumer protections in your place of residence continue to apply and are not excluded.

02

Eligibility and accounts

  • You must have legal capacity to enter a binding agreement and provide accurate, current information.
  • Keep credentials confidential, use the correct buyer or seller role, and notify Curio of suspected unauthorised access.
  • Curio may require verification, restrict duplicate or abusive accounts, and suspend access for security, legal or marketplace-integrity reasons.
03

How the marketplace works

Curio operates and moderates a multi-seller marketplace. Approved sellers offer objects; buyers purchase through Curio's checkout. A seller remains responsible for lawful ownership, listing accuracy, authenticity and condition claims, packing, dispatch and fulfilment, while Curio applies review standards and coordinates buyer protection.

Curio may edit, reject, flag, unpublish or remove listings and may investigate conduct, but review is not a guarantee that every fact or defect can be independently verified.

04

Listings, prices and availability

  • Vintage objects are often singular. Images, reports and measurements describe the specific offered item unless clearly stated otherwise.
  • Prices and currency are shown before checkout. Obvious errors may be corrected before confirmation.
  • Adding an object to a cart does not reserve it. Availability and price are checked and locked during checkout.
  • If an object becomes unavailable or materially changes before confirmation, checkout will stop and provide an updated quote.
05

Orders, charges and payment

An order becomes confirmed when Curio issues an order confirmation after the server has validated availability, address, price, delivery fee and payment status. A multi-seller cart creates one Curio order with separate seller fulfilments.

The current development environment uses a clearly labelled simulated payment and does not charge real funds. Before production launch, Curio must identify the live payment processor, accepted methods, settlement rules, refunds and processor terms.

  • Totals are calculated by Curio's server, not by browser-supplied values.
  • The current default insured-delivery fee is €45 for each seller represented in the cart.
  • Taxes, GST/VAT, import duties, brokerage and destination charges may apply as described in the Shipping Policy.
06

Cancellation, returns and refunds

Cancellation before shipment is a request and may depend on whether preparation or dispatch has started, without limiting statutory cancellation rights. Return requests are governed by the Returns Policy, including the standard 14-day inspection window from confirmed delivery.

Refund timing, method, delivery-fee treatment and deductions depend on the reason, applicable law and payment provider. No clause limits remedies that consumer law requires.

07

Seller responsibilities

  • Have legal title and authority to list, sell and export the object.
  • Provide complete, accurate evidence about identity, condition, restoration, provenance, dimensions and function.
  • Comply with product, cultural-property, sanctions, tax, customs, consumer and distance-selling obligations.
  • Pack safely, dispatch within the stated policy, provide valid tracking and cooperate with returns, disputes and investigations.
  • Pay disclosed commission and accept payout holds, reversals or refunds under the seller agreement and applicable law.
08

Messages and acceptable use

Private inquiries may be stored and reviewed where necessary for safety, support, disputes or legal compliance. Users must not use Curio to harass, deceive, evade fees, distribute malware, obtain unlawful goods, infringe rights, manipulate reviews or move a transaction off-platform to avoid protections.

Curio may moderate, preserve, restrict or disclose content when reasonably necessary and lawful.

09

Intellectual property and user content

Curio's brand, catalogue design, software, editorial text and original media are protected. You may use the service for personal or authorised business activity but may not scrape, reproduce or commercialise it without permission.

Sellers retain rights in content they provide and grant Curio a worldwide, non-exclusive, royalty-free licence to host, adapt, moderate, display and promote that content for marketplace operation. Users warrant they have the required rights.

10

Vintage goods, liability and mandatory rights

Age-consistent patina, disclosed restoration and known wear are part of a vintage object's documented condition. They do not excuse material misdescription, undisclosed damage, lack of title or failed statutory guarantees.

Nothing excludes liability for fraud, wilful misconduct, death or personal injury caused by negligence, or any liability or consumer remedy that law does not permit us to exclude. Subject to those rights, Curio is not responsible for indirect loss, external services, customs decisions or events beyond reasonable control. Any lawful cap must be reviewed and finalised for the registered Indian operator before launch.

11

Suspension, termination and changes

Users may stop using Curio, but outstanding orders, returns, payouts, disputes and legal obligations continue. Curio may suspend or terminate access where reasonably necessary for breach, security, fraud, legal compliance or marketplace protection.

Terms may change for legal, operational or product reasons. Material changes will be dated and notified where required; changes will not retroactively remove accrued mandatory rights.

12

Disputes, governing law and contact

Contact support first so Curio can investigate. Order support is available at [email protected] and general support at [email protected]. Consumers may also use any regulator, court, commission or dispute process available under mandatory local law.

Subject to non-waivable local consumer rights, these Terms are governed by Indian law and disputes are subject to the competent courts at the registered location of Curio's Indian operator. The final city, entity and grievance details must be inserted before launch.
